1. Acceptance of Terms
By accessing, browsing, or using the website located at https://www.cybrinal.com/ (the “Site”) and engaging with the services provided by Cybrinal (“Company,” “we,” “us,” or “our”), including but not limited to Web Development, Shopify Solutions, Cybersecurity Consulting, and related IT services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”).
These Terms apply to all services provided by SYNE TECH INC., including our Shopify applications.
These Terms constitute a legally binding agreement between you, whether personally or on behalf of an entity (“Client,” “User,” or “you”) and Cybrinal. If you do not agree to these Terms, you are strictly prohibited from using the Site and Services (including our Shopify applications).
2. Services Provided
Cybrinal specializes in professional web solutions and optimization strategies. Our primary services include:
2.1 Website Design & Development
We provide comprehensive website building services, including architecture design, theme customization, and content layout. This service includes basic security configurations and IT setup incidental to the website launch.
2.2 Advanced Website Optimization
We offer specialized optimization services designed to improve your website’s visibility and performance across various platforms, including:
- SEO (Search Engine Optimization): Strategies to improve ranking on traditional search engines like Google.
- GEO (Generative Engine Optimization): Optimization for AI-driven search experiences.
- AEO (Answer Engine Optimization): Structuring content to be cited by answer engines and voice assistants.
2.3 Proprietary Shopify Plugins
We provide access to and support for our self-developed (proprietary) Shopify plugins and tools to enhance your e-commerce store’s functionality.
Please note: We do not offer custom app development services for individual clients; our support is limited to the configuration and troubleshooting of our own products.
3. Client Obligations
By using our Services, you represent and warrant that:
- Authority: You have the legal capacity and authority to enter into these Terms.
- Cooperation: You will provide all necessary access, content, and information (e.g., CMS access, analytics accounts) required for us to perform the Services.
- Legality: You will not use our Services for any illegal purpose, including hosting malicious software or infringing upon intellectual property rights.
- Backups: Unless explicitly stated in a separate written agreement, you are solely responsible for maintaining independent backups of your data.
4. Fees and Payment
4.1 Pricing
Services are offered either on a Project Basis (e.g., for website builds) or a Subscription/License Basis (e.g., for plugin usage or ongoing optimization). All fees are in U.S. Dollars (USD) unless otherwise stated.
4.2 Payment Terms
Invoices: Invoices are due as specified in your service contract (e.g., upon receipt, Net 15, or Net 30).
Late Payments: We reserve the right to suspend Services for any accounts that are past due. A late fee may be applied to overdue balances.
Refunds: Unless otherwise provided by law or a specific service agreement, all fees paid are non-refundable.
5. Intellectual Property Rights
5.1 Our IP (Proprietary Tools & Plugins)
The Site, its original content, and the proprietary Shopify plugins, software, and tools developed by Cybrinal remain the exclusive property of Cybrinal.
License to Use: For our plugins and software tools, we grant you a limited, non-exclusive, non-transferable, and revocable license to use them for your business purposes, subject to your payment of applicable fees. You may not reverse engineer, resell, or redistribute our proprietary plugins.
5.2 Client Ownership (Website Deliverables)
Upon full payment of all applicable fees for Website Development projects:
Ownership: You obtain ownership of the final website design and the specific code implemented for your site (excluding our background IP/plugins).
Content: You retain full ownership of all text, images, and data you provide to us for the website.

7. Disclaimer of Warranties
The Services are provided on an “as-is” and “as available” basis. To the fullest extent permitted by law, Cybrinal disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Specific Disclaimers:
Optimization Results (SEO/GEO/AEO): While we employ advanced strategies to improve your online visibility, Cybrinal does not guarantee specific rankings, traffic levels, or inclusion in search engine results or AI responses. Algorithms for search engines (like Google) and AI models (like ChatGPT) are controlled by third parties and change frequently.
Security: We implement standard security best practices during website development. However, this does not constitute a dedicated cybersecurity service. We do not guarantee that your website will be immune from all cyber-attacks, malware, or unauthorized access.
Third-Party Platforms: We are not responsible for updates, downtime, or policy changes by third-party platforms (e.g., Shopify, Google, Hosting Providers) that may affect your website or the functionality of our plugins.
8. Limitation of Liability
In no event shall Cybrinal, its directors, employees, partners, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of the Services; (ii) any conduct or content of any third party; or (iii) unauthorized access, use, or alteration of your transmissions or content.
Our total liability for any claim arising out of or relating to these Terms or our Services shall not exceed the amount paid by you to Cybrinal in the six (6) months preceding the event giving rise to the claim.
9. Indemnification
You agree to defend, indemnify, and hold harmless Cybrinal from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney’s fees) arising from:
Your use of and access to the Service;
Your violation of any term of these Terms;
Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
10. Governing Law and Dispute Resolution
These Terms shall be governed by and defined following the laws of the State of California, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms shall be resolved through binding arbitration in Santa Clara County, California, or in a court of competent jurisdiction in the aforementioned location.
11. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
